Terms of Use
The terms for using NIBS Campus, the Workplace Lab, the community and the e-Learning Cafes. Version 1.0, effective 23 September 2026.

1. Who we are
These Terms of Use ("Terms") govern your use of websites, platforms, learning services and related services provided by Naleli Innovations (Pty) Ltd ("Naleli", "we", "us" or "our"), including where applicable:
- Naleli websites and services;
- NIBS learning services and NIBS Campus;
- the NIBS Katlehong campus (Katlehong Computer School), e-Learning Cafe 001;
- NIBS courses, programmes and career pathways;
- the NIBS Skills Passport and credential-verification services;
- the NIBS Workplace Lab;
- NIBS community features;
- e-Learning Cafe services;
- organisation and employer services;
- payment, order and subscription services; and
- any related web, portal, mobile, API, support or communication service.
For these Terms, all of the above are referred to collectively as the "Services".
Naleli Innovators Business School ("NIBS") is the education division of Naleli and the school through which the learning Services are offered.
Naleli is the legal operator of the Services unless a specific service, programme, partner agreement or transaction states otherwise.

2. Acceptance of these Terms
By creating an account, enrolling in a programme, purchasing a Service, accessing NIBS Campus, using the Workplace Lab, participating in the community, or otherwise using the Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
Before you place an electronic order, we aim to give you a reasonable opportunity to:
- review the transaction;
- correct mistakes;
- see the applicable price and material terms; and
- withdraw before finally submitting the order.
Nothing in these Terms is intended to waive or limit a right that cannot lawfully be waived under South African law.
3. South African law and consumer rights
These Terms are governed by applicable South African law, including where relevant:
- the Electronic Communications and Transactions Act 25 of 2002 ("ECTA");
- the Consumer Protection Act 68 of 2008 ("CPA");
- the Protection of Personal Information Act 4 of 2013 ("POPIA");
- the Promotion of Access to Information Act 2 of 2000 ("PAIA"); and
- other legislation applicable to a particular transaction, programme or service.
Where the CPA, ECTA or another law gives you mandatory rights that are more favourable than these Terms, the law prevails.
4. Eligibility and age
Unless a particular programme expressly states otherwise, self-service NIBS accounts are intended for people who are 18 years or older.
A person under 18 may only participate where:
- the programme allows it;
- any required parent, guardian or competent-person consent has been obtained;
- the relevant privacy and child-protection requirements are satisfied; and
- Naleli is reasonably able to provide the Service safely and lawfully.
You must not create an account using false identity information or impersonate another person.
5. Your account
You are responsible for your account.
You agree to:
- provide accurate and reasonably up-to-date information;
- create only one personal learner account unless Naleli authorises otherwise;
- keep your password, one-time codes and authentication details confidential;
- not share your account with another person;
- notify us promptly if you believe your account has been compromised; and
- use the Services only for lawful purposes.
Your learner account is personal to you and may not be sold, transferred, rented or assigned.
We may require identity or account verification where reasonably necessary for security, assessment integrity, funded programmes, certification, credential verification or legal compliance.
6. NIBS Campus
NIBS Campus is the learner environment through which you may access:
- courses and learning materials;
- learner community spaces;
- announcements;
- programme information;
- learning progress;
- support;
- Skills Passport features;
- Workplace Lab links or activities;
- assessment information; and
- credentials or transcripts.
Access to a course or feature may depend on:
- successful registration;
- programme eligibility;
- payment status;
- membership status;
- completion of prerequisite learning;
- a facilitator or administrator assigning access; or
- another condition clearly stated before or during enrolment.
7. Learning, assessment and academic integrity
7.1 Your own work
Unless a task expressly allows collaboration, work submitted for assessment must be your own.
You must not:
- submit another person's work as your own;
- purchase or obtain assessment answers dishonestly;
- fabricate evidence;
- alter evidence to mislead an assessor;
- impersonate another learner;
- allow another person to complete an assessment on your behalf; or
- interfere with an assessment, credential or verification process.
7.2 Use of AI tools
AI tools may be permitted for some learning activities and restricted for others.
Where a task or programme gives specific AI-use instructions, those instructions form part of the assessment requirements.
You remain responsible for:
- the accuracy of work you submit;
- checking AI-generated content;
- disclosing AI use where required;
- respecting copyright, confidentiality and privacy; and
- demonstrating your own competence.
Use of AI does not automatically prove competence.
7.3 Assessment outcomes
Learning progress, task completion and course completion do not automatically mean that a learner has been found competent.
Where a programme includes assessment, outcomes may include:
- not assessed;
- submitted;
- under review;
- resubmission required; and
- competent.
Only an authorised assessment decision may record a competency as achieved where the programme requires assessment.
7.4 Resubmissions
If an assessment requires resubmission, you may be allowed to submit a further attempt subject to:
- the programme rules;
- assessment deadlines;
- any stated attempt limits; and
- any applicable additional assessment fee disclosed before the fee is charged.
Previous assessment decisions may remain part of the audit history.
7.5 Review or appeal
Where NIBS provides an assessment-review or appeal process, you must use that process within the stated period.
A review does not guarantee that an assessment outcome will change.
8. Programme descriptions, recognition and accreditation
NIBS aims to describe each programme accurately.
A programme page may state information such as:
- programme type;
- duration;
- level or intended audience;
- learning outcomes;
- assessment approach;
- credential offered;
- fees;
- professional recognition; and
- formal qualification or accreditation status.
Recognition applies only where it is expressly stated for that specific programme.
NIBS is a QCTO-accredited Skills Development Provider for specific occupational qualifications and skills programmes. Each of those programme pages shows its accreditation number and the date its accreditation runs to. Those programmes are delivered and assessed only at the accredited address, 824 Sontonga Road, Ramokonopi Section, Katlehong, 1431, Gauteng, and their certificates are issued by the QCTO, not by NIBS.
A NIBS course, certificate, Skills Passport entry or professional credential must not be interpreted as a QCTO, SAQA, SETA, university, professional-body or other externally recognised qualification unless that status is expressly stated and valid for that programme.
We will not intentionally imply accreditation, professional recognition, CPD status or qualification status that has not been confirmed.
9. The NIBS Workplace Lab
The NIBS Workplace Lab provides practical task-based learning and assessment experiences.
It may use FluentBoards or another work-management system behind the learner-facing interface.
9.1 Workplace activity
A learner may be assigned practical activities with statuses such as:
- assigned;
- in progress;
- submitted;
- under review; and
- closed.
These are workflow states only.
A completed or closed task does not automatically mean that the learner is competent.
9.2 Evidence
You may upload documents, screenshots, files, comments or other evidence.
You must not upload:
- malware or malicious files;
- content you do not have permission to use;
- unnecessary personal information about another person;
- confidential employer information without permission;
- unlawful or abusive content; or
- information that violates another person's rights.
You grant Naleli the limited rights reasonably necessary to host, copy, display internally, assess, back up and retain your submitted evidence for the purpose of providing the Service, maintaining assessment records and meeting legitimate audit or compliance requirements.
You retain ownership of your original work, subject to any third-party rights in materials you used.
9.3 Private evidence
Workplace evidence is private by default unless a specific item is intentionally published or shared through a feature such as the Public Skills Passport.
Private evidence files, internal assessor notes and feedback are not intended to appear publicly.
9.4 Workplace assessment
Assessment decisions are stored separately from workflow progress.
Only an authorised assessor may make an assessment decision that changes a competency outcome.
10. Community conduct
The NIBS community exists for learning, support, professional development and constructive participation.
You must not:
- harass, threaten or abuse another person;
- use hate speech or discriminatory abuse;
- post unlawful, defamatory or deliberately harmful content;
- publish another person's personal information without lawful justification;
- spam, advertise or solicit without permission;
- impersonate staff, facilitators or another learner;
- distribute malware or attempt to compromise the Service;
- scrape, harvest or collect user information without permission;
- manipulate votes, reviews, results or community features dishonestly; or
- use the community in a way that materially interferes with other learners.
Naleli may moderate, hide or remove content that breaches these Terms or applicable law.
Serious or repeated misuse may lead to restricted access or account suspension.
11. Fees, prices and payment
11.1 Prices
The price shown for a Service at the time of purchase is the applicable price unless there is an obvious error.
Before payment, we aim to disclose:
- the total price payable;
- applicable registration fees;
- recurring or instalment amounts;
- the payment schedule;
- any material additional fees;
- the payment method; and
- any minimum duration or renewal arrangement.
We will not charge an undisclosed fee.
11.2 Payment methods
Payment methods may include:
- EFT;
- Pay@;
- Paystack;
- PayFast; and
- other payment methods enabled from time to time.
Third-party payment providers may apply their own terms and privacy notices.
Naleli does not intend to store full payment-card numbers or online-banking credentials.
11.3 Proof of payment
Uploading a proof of payment does not itself mean that payment has been verified.
Where manual verification applies, access that depends on payment may remain pending until the payment has been confirmed.
11.4 Failed, reversed or fraudulent payments
If a payment is unsuccessful, reversed, charged back, fraudulent or otherwise invalid, Naleli may:
- withhold access not yet provided;
- suspend paid access while the issue is investigated;
- correct an incorrectly recorded payment status; or
- recover an amount lawfully owing.
We will not deliberately remove a learner's earned assessment history or valid credential merely because a later unrelated payment fails, unless the credential itself was obtained through fraud, error or a transaction that lawfully permits reversal.
12. Refunds, cooling-off rights and cancellations
Naleli will publish a Refund and Cancellation Policy before charging paid learners.
That policy forms part of these Terms.
Nothing in that policy may remove a statutory consumer right.
12.1 Electronic cooling-off rights
Where section 44 of ECTA applies, a consumer may have the right to cancel an electronic transaction for services within the statutory cooling-off period.
ECTA also contains exceptions, including where services begin with the consumer's consent before the end of that cooling-off period.
Where Naleli asks you to begin a paid service immediately, we may ask you to expressly confirm that immediate commencement.
12.2 Consumer cancellations
Where the CPA, ECTA or another law gives you a cancellation or refund right, that right applies regardless of any less favourable wording in a Naleli policy.
Where a cancellation fee is legally permitted, it will not exceed what the applicable law allows.
12.3 Naleli cancellation
If Naleli cancels a paid course or service and cannot provide a reasonably equivalent alternative acceptable to you, we will deal with amounts paid in accordance with applicable law and the Refund and Cancellation Policy.
13. Subscriptions and recurring services
Where NIBS offers a subscription, including NIBS Plus, the checkout must state the material subscription terms before you subscribe.
These may include:
- billing frequency;
- amount;
- renewal date;
- minimum term, if any;
- how to cancel;
- what happens after cancellation;
- failed-payment handling; and
- when access ends.
A cancellation normally stops future renewal but does not automatically reverse a payment already lawfully earned, subject to your statutory rights and the applicable refund policy.
We will implement recurring billing only through payment methods and providers configured for that purpose.
14. Credentials, certificates and transcripts
NIBS may issue:
- Certificates of Completion;
- Module Completion Attestations;
- Skills Course Certificates;
- Professional Certificates;
- the NIBS Official Learning and Skills Transcript;
- verified skills and digital credential records; and
- related verification records.
NIBS does not issue certificates for QCTO qualifications. The QCTO issues them.
The specific credential available depends on the programme.
14.1 Eligibility
A credential may require:
- completion of specified learning;
- achievement of required competencies;
- successful assessment;
- Workplace Lab requirements;
- payment or administrative requirements where lawful and disclosed; and
- other programme-specific requirements.
A credential will not be issued merely because a learner enrolled in a programme.
14.2 Verification
NIBS credentials may include a unique credential identifier or public verification page.
Verification may show limited information such as:
- learner name where appropriate;
- credential title;
- issuer;
- issue date;
- credential status; and
- verified skills or competencies.
14.3 Correction, suspension or revocation
Naleli may correct, suspend or revoke a credential where there is a reasonable basis, including:
- administrative or system error;
- identity fraud;
- fabricated assessment evidence;
- serious academic misconduct;
- duplicate issuance;
- a credential having been issued before its requirements were actually met; or
- another lawful reason affecting the validity of the credential.
Where practical and appropriate, the learner will be informed of the reason and any available review process.
A credential will not be revoked merely because Naleli later changes a programme, where the learner validly earned the credential under the requirements that applied at the time.
15. Skills Passport and public sharing
The private Skills Passport may contain:
- learning history;
- programme progress;
- credentials;
- skills;
- assessment outcomes; and
- Workplace Lab information.
15.1 Public Skills Passport
Public Skills Passport sharing is intended to be opt-in.
If you choose to publish it, selected information may be available to employers, recruiters, professional bodies and anyone with the public link.
You control the public-sharing options made available in the Service.
We may provide controls to:
- publish;
- preview;
- copy a public link;
- select what is shown;
- unpublish; and
- regenerate or revoke a sharing link.
A third party may retain a screenshot or copy of information you voluntarily published. Naleli cannot control copies made by independent third parties after lawful public sharing.
16. e-Learning Cafes
Some Services may be accessed through a NIBS e-Learning Cafe or authorised learning centre.
Additional local rules may apply regarding:
- opening hours;
- equipment use;
- bookings;
- printing;
- network use;
- learner assistance;
- safety;
- conduct on premises; and
- damage to equipment.
You must use centre equipment responsibly.
An e-Learning Cafe operator may assist you with registration or platform use, but should not:
- ask for or keep your password;
- complete assessments for you;
- impersonate you;
- alter assessment evidence; or
- misrepresent your identity or results.
17. Intellectual property
The Services may contain materials owned by Naleli or licensed to Naleli, including:
- course materials;
- videos;
- text;
- graphics;
- templates;
- software;
- assessments;
- website design;
- trademarks; and
- programme content.
Unless stated otherwise, you receive a limited, personal, non-exclusive, non-transferable right to use the materials for your own learning or authorised organisational use.
You must not, without permission:
- resell course content;
- reproduce substantial learning materials for commercial distribution;
- remove copyright or ownership notices;
- copy assessment banks or restricted facilitator materials;
- make NIBS content publicly available where it is not intended to be public; or
- use Naleli or NIBS branding in a way that falsely suggests endorsement, accreditation or partnership.
These Terms do not transfer ownership of Naleli intellectual property to you.
18. Content you provide
You retain ownership of content you create and submit, subject to third-party rights.
You grant Naleli a limited, non-exclusive licence to host, store, reproduce and process your content only to the extent reasonably necessary to:
- provide the Services;
- assess learning;
- operate your account;
- support your Skills Passport;
- create or verify credentials;
- maintain appropriate backups and audit records; and
- comply with law.
We do not obtain ownership of your CV, portfolio, assessment work or original learner evidence merely because you upload it.
Public testimonials, learner stories, photographs or marketing use require an appropriate lawful basis and, where required, consent.
19. Privacy
Our collection and use of personal information is governed by the Naleli Privacy Policy and applicable South African privacy law.
The Privacy Policy explains matters including:
- what personal information we collect;
- why we process it;
- who we share it with;
- cross-border processing;
- security;
- retention;
- your POPIA rights; and
- Public Skills Passport privacy.
The Privacy Policy forms part of the framework governing your use of the Services but does not reduce any rights you have under POPIA.
20. Third-party services
The Services may depend on third-party systems such as:
- payment providers;
- hosting and cloud providers;
- learning or community software;
- email providers;
- authentication providers;
- communication systems; and
- other integrated services.
A third party may have its own terms where you interact directly with its service.
Naleli is not responsible for a third party's independent acts or services to the extent that the third party determines its own processing or contractual relationship with you.
Where a third party acts on Naleli's behalf, Naleli remains responsible for managing that relationship in accordance with applicable law.
21. Acceptable use and security
You must not:
- attempt unauthorised access to another account, board, course, file or system;
- bypass access controls;
- probe or exploit vulnerabilities without written authorisation;
- interfere with platform availability;
- upload malicious code;
- scrape or extract platform or learner data without permission;
- reverse engineer protected systems except where law expressly permits it;
- manipulate payments, credentials or assessment records;
- use automation to overload or abuse the Service; or
- use the Services for unlawful conduct.
If you discover a possible security vulnerability, report it responsibly to compliance@naleli.co.za and do not exploit or publicly disclose it before Naleli has had a reasonable opportunity to investigate.
22. Suspension and termination
Naleli may suspend or restrict access where reasonably necessary to:
- protect users or systems;
- investigate fraud or security issues;
- respond to serious misconduct;
- prevent continuing breach of these Terms;
- comply with law;
- respond to a payment issue affecting paid access; or
- protect assessment or credential integrity.
Where reasonably practical, we will explain the reason.
Depending on the circumstances, suspension of platform access does not automatically erase:
- valid learning records;
- assessment history;
- lawfully issued credentials; or
- records we must retain.
You may stop using the Services at any time, subject to outstanding contractual obligations and applicable cancellation terms.
23. Availability and changes to the Services
We aim to provide reliable Services but do not promise uninterrupted availability.
We may need to:
- perform maintenance;
- correct errors;
- update security;
- replace software or providers;
- change a feature;
- retire a feature; or
- modify course delivery.
Where a material change affects a paid learner's core purchased service, we will act reasonably and in accordance with consumer law.
We may update course content to keep it relevant, but will not intentionally misrepresent what a learner purchased.
24. No guarantee of employment or business outcome
NIBS is designed to improve access to learning, practical skills, evidence and credentials.
However, unless expressly stated in a separate written agreement, Naleli does not guarantee:
- employment;
- a particular job;
- promotion;
- salary increase;
- admission to another institution;
- professional designation;
- business funding;
- tender success; or
- recognition by a specific employer or external institution.
Employers and third parties make their own decisions.
A Skills Passport, transcript or credential is evidence of the information it records, not a guarantee of employment.
25. Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by the CPA, ECTA or another applicable law.
Subject to those mandatory rights:
- Naleli is not responsible for loss caused solely by circumstances outside its reasonable control;
- learners are responsible for maintaining their own device, connectivity and account credentials unless the Service expressly provides these;
- Naleli is not responsible for independent decisions made by employers, funders, professional bodies or other third parties; and
- third-party services may occasionally be unavailable or changed by their providers.
Any limitation or exclusion in these Terms must be interpreted only to the extent lawful and reasonable under South African law.
26. Indemnity
To the extent permitted by law, you are responsible for losses or claims caused by your intentional unlawful conduct, fraud, infringement of another person's rights, or material breach of these Terms.
This clause does not require a consumer to indemnify Naleli for Naleli's own unlawful conduct, gross negligence or liability that cannot lawfully be excluded.
27. Complaints and disputes
If you have a complaint, please contact Naleli first so that we can try to resolve it.

Where a dispute relates to:
- privacy, POPIA or access to information, the applicable privacy and PAIA procedures may apply;
- a consumer transaction, you may have rights under the CPA or ECTA;
- a payment, the payment provider's dispute process may also apply; or
- an assessment, use the applicable NIBS academic review or appeal process.
Nothing in these Terms prevents you from approaching a regulator, consumer body, ombud, tribunal or court where the law gives you that right.
28. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa.
Subject to any mandatory consumer right to use another competent forum, disputes may be brought before a court or other competent body in South Africa with jurisdiction over the matter.
29. Electronic communications
You agree that Naleli may send necessary electronic communications relating to your account or Services, including:
- account verification;
- security notices;
- password resets;
- registration confirmations;
- payment receipts;
- learning administration;
- assessment notifications;
- credential notices;
- service changes; and
- legal or policy notices.
Marketing communications are handled separately and are subject to the consent and objection requirements described in our Privacy Policy and applicable law.
30. Changes to these Terms
We may update these Terms where reasonably necessary because of:
- changes in law;
- changes to the Services;
- new features;
- security needs;
- provider changes; or
- operational improvements.
The latest Terms will show the effective date.
If a change is material, we may notify affected users by email, in-product notice or another reasonable method.
Changes do not retrospectively remove rights that have already accrued under applicable law or a concluded transaction.
31. Entire agreement and severability
These Terms, together with applicable:
- programme terms;
- checkout information;
- Refund and Cancellation Policy;
- Privacy Policy;
- subscription terms;
- assessment rules; and
- other clearly incorporated policies,
form the agreement governing the relevant Service.
If part of these Terms is found unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
